The basics

Terms for shopping with The Collective.

We have kept these terms deliberately straightforward. They apply to retail purchases made directly from The Collective, whether you shop with us in person or place an order through our website.

1. About these terms

The Collective operates a retail store at 100 High Street, Hawera, New Zealand and an online store at thecollectivenz.co.nz.

The Collective is a business in trade. When you purchase from us as a consumer, your purchase is protected by applicable New Zealand consumer law.

By purchasing goods from us in store, or by submitting an online order, you agree to these Terms & Conditions together with any other terms clearly shown to you before the purchase is completed.

2. Products and descriptions

We take reasonable care to describe and photograph products accurately. However, colours may vary slightly because of lighting, photography and individual screen settings.

Many products sold by The Collective are handmade, handcrafted, created in small batches or made from natural materials. Small variations in colour, texture, grain, shape, pattern, dimensions, placement or finish may be part of the nature of the product rather than a fault.

Second-hand products may show reasonable signs of previous use. Any known material fault or condition issue that affects the item will be disclosed where required.

Product descriptions do not limit your rights where an item is materially different from its description or otherwise fails to meet a guarantee that applies under New Zealand law.

3. Pricing and payment

All prices shown by The Collective are in New Zealand dollars and include GST where applicable.

Any delivery charge or other applicable charge for an online order will be shown before you complete your purchase.

Payment must be made using one of the payment methods offered at the time of purchase. Where a third-party payment service such as Afterpay is available, that provider’s separate terms may also apply.

We make reasonable efforts to ensure prices are accurate. If a genuine pricing or listing error is identified before an online order has been accepted, we may correct the error and give you the option to proceed at the correct price or cancel the order. If we cancel after payment has been taken, the amount paid will be refunded.

4. Online orders

Placing an order through our website is an offer to purchase the products in your cart.

An automated order acknowledgement confirms that we have received your order. Your order is accepted once payment has been approved and we confirm that the goods are being prepared for collection or dispatch.

Before an order is accepted, we may decline or cancel it where reasonably necessary, including where:

  • the product is no longer available
  • payment cannot be authorised
  • there is a genuine pricing or product-listing error
  • the order appears fraudulent or unauthorised.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

5. Product availability

Many products are made in limited quantities or are one-off items. Products may also be available for sale in our physical store at the same time as they are listed online.

Occasionally an item may sell in store before online stock records have updated. If this happens after you place an online order, we will contact you as soon as reasonably possible and refund any amount paid for the unavailable item.

Adding an item to your online cart does not reserve that product.

6. Delivery

Available delivery methods, charges and any estimated delivery timeframe will be shown during checkout where applicable.

You are responsible for providing a complete and accurate delivery address. If additional delivery costs arise because an incorrect or incomplete address was supplied, we may charge the reasonable cost of re-delivery where permitted by law.

Where The Collective arranges delivery, we remain responsible for the order until it is delivered in accordance with our obligations under New Zealand consumer law.

If your order is delayed, lost or arrives damaged, please contact The Collective so that we can investigate and arrange any remedy required by law.

7. Click & collect

Where click & collect is offered, please wait until we confirm that your order is ready before coming to the store.

We may ask for your order confirmation or other reasonable proof that you are authorised to collect the order.

8. Returns and refunds

Our Returns & Refunds Policy forms part of these terms.

We do not offer returns, refunds or exchanges simply because you change your mind, choose the wrong item, decide an item does not suit you, or no longer want the product.

Second-hand clothing is final sale for change-of-mind purposes and cannot be returned, refunded or exchanged because of fit, size, style, preference or an issue that was disclosed or apparent when purchased.

These rules do not limit any remedy you are legally entitled to where a product fails to meet a guarantee under the Consumer Guarantees Act 1993.

9. Consumer rights

Products sold by The Collective to consumers are subject to the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

Among other things, products must be of acceptable quality, fit for their normal purpose and match their description. The Fair Trading Act also prohibits misleading or deceptive conduct.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer right or remedy that cannot legally be excluded.

10. Privacy

We may collect personal information such as your name, contact details, delivery address and order information where reasonably necessary to process purchases, fulfil orders and communicate with you.

Personal information is handled in accordance with the Privacy Act 2020. Further information about how personal information is collected, used and stored should be read in our Privacy Policy on this website.

11. Website use

We aim to keep our website and product information available and accurate, but we cannot guarantee that the website will always be uninterrupted or free from technical errors.

Temporary website unavailability does not affect any rights you have in relation to an order that we have already accepted.

You must not intentionally misuse the website, attempt to interfere with its operation, or use it for unlawful activity.

12. Changes to these terms

We may update these Terms & Conditions from time to time to reflect changes to our business, website or applicable law.

Any updated terms will apply from the date they are published. The terms that applied when an order was accepted will continue to apply to that order.

These Terms & Conditions are governed by the laws of New Zealand.
